To Use a Lawyer or Not to Use a Lawyer?
No, don’t use a lawyer
Social Security lawyers and representatives charge thousands of dollars, up to $6,000, as a percentage of your back pay that you receive when you win your claim. Back pay can be tens of thousands of dollars and they get 25% or more if they petition the court. Most all lawyers do not take your case until you have been denied knowing that if you file a claim on your own the chances of winning are slim.. Social Security claims representatives will file the initial application for you for same amount and percentages as lawyers. The downside of lawyers and representatives is that the longer your claim is in the appeal cycle the more money they make. So, if money is a motivation then they will try to keep your claim in the appeals cycle as long as possible.
On the other hand, the aim of SSDI Services is to file a wining initial claim so you don’t have to go through the appeals cycle. Our charge is up front and not tied to any timeframe.
Unlike claims representatives, So Cal Application Services does not represent you should your application be denied.
Yes, use a lawyer or claims representative
If you get denied then it’s best to use a Social Security lawyer or Claim Representative. They know the rules and procedures that govern the appeals process in front of administrative judges.
The National Organization of Social Security Claims Representatives, www.NOSSCR.org, and the National Association Disability Representatives, www.NADR.org are two resources to find an attorney or representative.
